PENEGAKAN HUKUM TINDAK PIDANA PENIPUAN DALAM JUAL BELI MOBIL BEKAS (Studi Kasus Di Polsek Duren Sawit)

Abstract

This study discusses Law Enforcement for cases of fraud in the sale and purchase of used cars, starting from the Regulation of Fraud and Law Enforcement from the Duren Sawit Police, the Obstacles faced by the Duren Sawit Police to catch the perpetrators of the crime, the mode of how the fraudulent sale and purchase occurred. The law aims to achieve order in society so that it is hoped that Law Enforcement for the crime of fraud in the sale and purchase of used cars with the Triangle mode with online media can be resolved. The researcher conducted a legal analysis of secondary legal materials related to the problems studied. The type of research that the author uses is the normative legal research method (empirical normative research). Empirical normative legal research is legal research conducted by means of case studies by looking for cases and also through legal materials. The results of the study show that legal regulations regarding criminal acts of fraud in the sale and purchase of used cars using the triangular fraud method via online media are regulated in Article 378 of the Criminal Code and Article 28 paragraph (1) of the ITE Law and law enforcement regarding criminal acts of fraud in the sale and purchase of used cars at the Duren Sawit Police Sector faces obstacles such as a lack of evidence from the victim, the difficulty of tracking down perpetrators who use fake identities, limited IT equipment, and bureaucracy in opening the perpetrator's account.
