ANALISIS HUKUM TERHADAP TINDAKAN PRAKTIK JUDI ONLINE DI JAKARTA DAN PENEGAKAN HUKUMNYA

Online gambling is currently a public concern, and the government is trying to eradicate the practice of online gambling with enforcement and regulations. Enforcement of online gambling practices is quite difficult due to developments in technology and modus operandi and bookies located outside the country, making this one of the obstacles in law enforcement. The purpose of this research is to find out how law enforcement is in terms of online gambling practices in Jakarta and also what are the obstacles to law enforcement in online gambling practices in Jakarta. Based on Law of the Republic of Indonesia number 1 of 2024 concerning the second amendment to Law number 1 of 2008 concerning Electronic Information and Transactions articles (27) and (45). Furthermore, Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code Articles (426) and (427), as well as Law Number 1 of 2006 concerning Mutual Assistance in Transnational Criminal Matters. And to increase the effectiveness of Law Enforcement, an Online Gambling Eradication Task Force was formed with synergy between institutions on the basis of Law (Keppres) Number 21 of 2024. This research method uses Normative Qualitative by analyzing written law from library materials and secondary legal sources. The results of this research concluded that 1) Law Enforcement is regulated in Law of the Republic of Indonesia Number 1 of 2024 ITE Articles (27) and (45), Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code Article (426) and (427), as well as Law Number 1 of 2006 concerning Mutual Assistance in Transnational Criminal Matters, (Presidential Decree) Number 21 of 2024 to eradicate the Practice of Online Gambling. 2) Bukit goods are important and difficult to obtain because transactions use electronics, requiring collaboration between government agencies and law enforcement. Suggestions from Research: 1) Increase ITE Knowledge capabilities in POLRI and collaborate with elements of society effectively. 2) Accountability and transparency in implementing the tasks of the online gambling eradication task force for the community.
