ANALISA HUKUM TERHADAP ANAK PELAKU TINDAK PIDANATERORISME DI INDONESIA

The involvement of children in criminal acts of terrorism in Indonesia has become an increasingly complex problem and requires a comprehensive approach to handling. This research aims to analyse the Law Against Child Perpetrators of Criminal Acts of Terrorism in Indonesia. The method used is normative legal research with statutory and conceptual approaches. The results show that the application of rehabilitation and reintegration in cases of child perpetrators of terrorism still faces various challenges. Although Law No. 11/2012 on Juvenile Justice System has accommodated the principle of rehabilitation and reinrtegration justice, its implementation in terrorism cases is still limited due to the serious nature of the crime. However, this study found that rehabilitation and reintegration have significant potential in the process of deradicalisation and reintegration of juvenile perpetrators of terrorism into the community. This study concludes that harmonisation between counter-terrorism policy and juvenile criminal justice system is needed to optimise the implementation of rehabilitation and reintegration. Recommendations include the development of deradicalisation programmes, increasing the capacity of law enforcement officers in handling juvenile cases, and strengthening the role of family and community in the rehabilitation and reintegration process.
