Abstract

Stalking is a series of actions following someone, either publicly or secretly, which causes the person to feel that their freedom of movement being restricted or places a person in fear of being intimidated or feeling threatened that their body will be harmed. This research will discuss about the instrument for dealing with the act of stalking through the implementation of restraining order and how restraining order in Indonesia legal system. The method of this research is normative juridicial and uses statute approach and conceptual approach obtained from primary, secondary, and tertiary legal sources. Restraining order is an order issued by a court to a person for a criminal act he has commited against a person who has been harmed by his action, where the order requires the restriction of several rights and freedom of movement solely for the protection and recovery of the victim from the impacts caused.
