PERTANGGUNGJAWABAN PIDANA PELAKU TINDAK PIDANA MELAKUKAN KEKEJAMAN, KEKERASAN ATAU ANCAMAN KEKERASAN ATAU PENGANIAYAAN TERHADAP ANAK HINGGA LUKA BERAT (Analisis Putusan PN Jakarta Utara Nomor 82/Pid.Sus/2025/PN Jkt.Utr)

Abstract

Crimes of violence against children often occur in our environment, the perpetrator must be held accountable for his actions. For this reason, it will be further studied how the regulation of criminal acts of committing cruelty, violence or threats of violence or abuse against children to the point of serious injury based on legislation in Indonesia and how the criminal responsibility of perpetrators of criminal acts of committing cruelty, violence or threats of violence or abuse against children to the point of serious injury based on the decision of the North Jakarta District Court number 82 / Pid.Sus / 2025 / PN Jkt.Utr. The research method used in this study is the normative legal research method. From the results of the study, it was found that the regulation of criminal acts of committing cruelty, violence or threats of violence or abuse against children to the point of serious injury based on legislation in Indonesia, is regulated in Law 23/2002 Jo. Law 35/2014 Jo Perpu 1/2016 Jo. Article 80 paragraph (2) of Law 17/2016 and the criminal liability of perpetrators of criminal acts of cruelty, violence or threats of violence or abuse against children to the point of serious injury based on the decision of the North Jakarta District Court number 82/Pid.Sus/2025/PN Jkt.Utr, with a prison sentence of 3 (three) years and 6 (six) months and a fine of Rp. 100,000,000.00 (one hundred million rupiah) with the provision that if the fine is not paid it will be replaced with imprisonment for 3 (three) months. For improvements, it is necessary to regulate criminal acts of cruelty, violence or threats of violence or abuse against children, the sanctions or punishments must be made more severe, so new regulations must be formed in the Criminal Code, Legislation, Government Regulations, Permenkumham and the Panel of Judges in deciding cases of cruelty, violence or threats of violence or abuse against children must provide the maximum sanctions or punishments so that there are no more similar incidents and children are truly protected.
