PERLINDUNGAN HUKUM TERHADAP KONSUMEN PROPERTI ATAS KETERLAMBATAN DEVELOPER MENYERAHKAN AKTA JUAL BELI (AJB) TANAH DAN BANGUNAN RUMAH

Abstract

This study discusses legal protection for property consumers who experience delays in developers submitting Deeds of Sale and Purchase (AJB) for land and houses. The main issues studied include: (1) the extent to which statutory provisions guarantee consumers' rights to timely delivery of AJB, (2) legal obstacles in enforcing sanctions against developers, and (3) efforts to improve consumer protection mechanisms. The method used is normative juridical with a statutory approach and a conceptual approach. Primary and secondary legal materials are analyzed comparatively to evaluate the effectiveness of provisions in Law No. 8 of 1999 concerning Consumer Protection, Law No. 5 of 1960 concerning Basic Agrarian Principles, and related Government Regulations and implementing regulations. The results of the study indicate that although normatively consumers have the right to compensation and administrative sanctions, implementation in the field is often hampered by weak supervision, complicated lawsuit procedures, and low consumer awareness of their rights. Alternative dispute resolution mechanisms through the Consumer Dispute Resolution Agency (BPSK) are less than optimal due to limited authority and the unpopularity of mediation procedures.
